These Terms of Service (“Terms”) govern your use of winterose.us (the “Site”) and any purchase you make from Winterose. Winterose is a sole proprietorship owned by Abida Abdelaziz, located at 1206 Laurel St, Nashville, TN 37203, USA (“Winterose”, “we”, “us” or “our”). By using the Site or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. We sell to customers with shipping addresses in the 48 contiguous United States only.
2. Products and descriptions
We make every effort to describe products accurately, including specifications provided by manufacturers. Colors and images may differ slightly from the actual product. Manufacturers may change specifications without notice. If a product is not as described, your remedy is to return it under our Refund & Return Policy.
Brand names and trademarks belong to their respective owners and are used only to identify the products we sell. Winterose is an independent retailer and is not affiliated with or endorsed by the manufacturers.
3. Prices and availability
All prices are in US dollars. We may change prices at any time, but changes do not affect orders already confirmed. If a product is listed at an incorrect price because of an error, or becomes unavailable, we may cancel the order and refund you in full. We will notify you if this happens.
4. Orders
Your order is an offer to buy. We accept your order when we ship it. We may refuse or cancel an order, for example in case of suspected fraud, a pricing error, or an address we cannot ship to; in that case you will receive a full refund.
5. Payment
Payment is processed securely by Stripe. By providing a payment method, you confirm you are authorized to use it. Sales tax is added at checkout where applicable. See our Payment Policy.
6. Shipping
We charge a flat shipping rate of $26 per order. Handling takes 1–2 business days and transit 2–5 business days. Title and risk of loss pass to you when the order is delivered to the carrier, but we will help you resolve any shipping damage or loss as described in our Shipping Policy.
7. Returns, refunds and cancellations
Returns are accepted within 30 days of delivery for unused, unfueled items in original packaging. Orders can be cancelled free of charge before they ship. Full details are in our Refund & Return Policy.
8. Warranty
Products are covered by their manufacturer’s warranty, under the manufacturer’s terms. Winterose does not provide a separate warranty, but we will help you file warranty claims. Except as stated in these Terms and as required by law, products are sold without additional warranties from Winterose.
9. Safe use
Snow blowers are powerful machines. Always read and follow the manufacturer’s operator manual and safety instructions. Winterose is not responsible for injury or damage caused by misuse, improper assembly, modification or failure to follow the manufacturer’s instructions.
10. Your account
If you create an account, you are responsible for keeping your password confidential and for activity under your account. Tell us promptly about any unauthorized use.
11. Use of the Site
You agree not to misuse the Site, including attempting to access it without authorization, interfering with its operation, or using it for any unlawful purpose. Site content, text, graphics and layout are owned by Winterose or its licensors and may not be copied without permission.
12. Limitation of liability
To the fullest extent permitted by law, Winterose is not liable for indirect, incidental, special or consequential damages arising from your use of the Site or products purchased from us. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms limits rights you have under applicable consumer protection laws.
13. Privacy
Your use of the Site is also governed by our Privacy Policy.
14. Governing law
These Terms are governed by the laws of the State of Tennessee and applicable US federal law. Any dispute will be handled in the state or federal courts located in Davidson County, Tennessee, unless applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows when they were last changed. Changes apply to orders placed after the update.
